Terms of Service

These Terms of Service ("Terms") govern your use of ZeroDownScout ("ZeroDownScout," "we," "us," or "our"), a product of Own The Roof Inc. ("Own The Roof Inc."), including the ZeroDownScout mobile application (iOS and Android) and the website at zerodownscout.com (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

2. The Service

ZeroDownScout matches you with down payment assistance ("DPA") programs you may qualify for based on the information you provide. The Service is informational. Eligibility for any specific program is ultimately determined by the program administrator, lender, or government agency, not by ZeroDownScout. We do not guarantee approval, funding, or program availability.

3. SMS Program Details

If you opt in to receive SMS messages, the following terms apply to our SMS program:

  • Description & Use Cases: Our SMS program sends two categories of messages. Informational messages include account verification codes (OTP), down payment assistance program updates, application reminders, and educational content about homeownership. Promotional messages include occasional offers, tips, and program highlights related to down payment assistance.
  • Opt-In: Users opt in by completing the form on zerodownscout.com and affirmatively checking the optional SMS consent checkbox. SMS consent is optional and is never required to use the Service.
  • Opt-Out: You can stop receiving SMS messages at any time by replying STOP to any message. After replying STOP, you will receive a single confirmation message and no further SMS will be sent.
  • Help: Reply HELP to any message for assistance, or contact our support team at [email protected] or (313) 631-8277.
  • Message Frequency: Message frequency varies based on user activity, typically 2 to 6 messages per month.
  • Message & Data Rates: Message and data rates may apply. Check with your mobile carrier for details.
  • Carrier Liability: Carriers are not liable for delayed or undelivered messages.
  • Privacy: Your phone number and SMS consent will not be sold, shared, or transferred to third parties for their own marketing purposes. See our Privacy Policy for full details.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at [email protected] if you suspect unauthorized use of your account.

5. Acceptable Use

When using the Service, you agree not to:

  • Provide false, inaccurate, or misleading information
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any unlawful purpose
  • Reverse engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Resell, redistribute, or commercially exploit the Service or its content

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by Own The Roof Inc. and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

7. Lender Introductions

If you request to be connected with a lender, ZeroDownScout will share your information with that lender on your behalf. Any subsequent communication, application, or transaction with that lender is governed by the lender's own terms and policies, not these Terms. ZeroDownScout is not a party to and is not responsible for the outcome of any loan application or transaction.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. ZeroDownScout makes no warranties regarding the accuracy, completeness, or reliability of program information, and is not responsible for changes to programs by their administrators. Eligibility shown in the Service is an estimate based on the information you provide and is not a guarantee of approval or funding.

9. Limitation of Liability

To the fullest extent permitted by law, Own The Roof Inc. and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our aggregate liability shall not exceed one hundred U.S. dollars ($100).

10. Indemnification

You agree to indemnify and hold harmless Own The Roof Inc., its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising out of your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, without notice, for any reason, including violation of these Terms. You may stop using the Service at any time. Sections of these Terms that by their nature should survive termination will survive termination.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be posted on this page with a new "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Oakland County, Michigan.
